The applicant, who was injured in a 2022 motor vehicle accident, had a documented history of chronic back pain stemming from a prior accident. The Tribunal found that this pre-existing condition was well-supported by medical records and played a significant role in complicating the applicant’s recovery. The Applicant sought payment for Botox injections, an occupational therapy in-home assessment and Form 1 (attendant care assessment), and a physiatry assessment. Before the hearing, the parties resolved all substantive benefit issues, leaving only the question of a special award under s. 10 of O. Reg. 664. The insurer argued that the Tribunal had no jurisdiction to make the award since all benefits had been paid. Adjudicator Paluch agreed with the claimant that the Tribunal had jurisdiction to issue a special award even if no benefits remained in dispute. He concluded that the insurer had been unreasonably slow in responding to the claims for NEBs and medical benefits, and that a special award was warranted. He considered seven factors (blameworthiness of the insurer; vulnerability of the claimant; harm or potential harm directed at the claimant; need for deterrence; advantage wrongfully gained by the insurer from the misconduct; any other penalties imposed on the insurer; the overall length in delay) in concluding that an award of 40 percent was appropriate. Aviva Insurance Canada*, 2021 CanLii 13209 (ON LAT) 19-014428/AABS ## Partial entitlement granted: massage therapy awarded for insurer’s non-compliance The claimant sought entitlement to two treatment plans, including massage therapy and a chronic pain assessment following a 2017 motor vehicle accident. Adjudicator Lake found that the claimant was entitled to a portion of the remaining amount for the massage therapy as the accident caused or worsened Mr. Budhram’s neck, back, and shoulder conditions. The claimant submitted that the insurer failed to comply with its obligations under section 38(8). Based on a plain reading of section 38(11)(2), the insurer is liable for payment of the proposed treatment described in the disputed OCF-18 that relates to the period starting on the 11th business day after the day that the insurer received the OCF-18 and ending on the day the insurer gives a notice described in section 38(8). Adjudicator Lake also stated that the amount does not need to be incurred during that time. Finally, Adjudicator Lake concluded that medical reasons provided under a separate heading for an IE do not mitigate the requirement of the insurer to provide medical reasons for its denial of the OCF-18 under section 38(8). While they have been reducing available funding and refusing to increase benefits with inflation for years, this change will affect every Ontarian dramatically. ## Benefits Effective July 1, 2026, the only benefits to become **mandatory** in Ontario will **be medical and rehabilitation benefits and attendant care benefits**. Any other benefit will become optional. The optional benefits as of July 1, 2026 will be: 1. Income Replacement Benefits 2. Non Earner Benefits 3. Caregiver Benefits 4. Educational Expenses 5. Visitor Expenses 6. Housekeeping / Home Maintenance Expenses 7. Damage associated with damage to clothing, glasses, hearing aids, etc. 8. Death Benefits 9. Funeral Benefits Policyholders can choose to purchase these benefits, tailoring their coverage to meet their specific needs. For insurance professionals, this shift represents a significant opportunity. Insurers can now offer customizable packages that appeal to different client needs. Families looking for comprehensive protection can purchase higher limits on income replacement or additional coverage for caregivers, while individuals seeking more budget-friendly options may opt out of certain benefits they don’t foresee needing. This flexibility allows professionals to educate clients on balancing costs with coverage, offering tailored advice based on each family’s situation. ## Payment Priority The second proposed amendment would modify the *Insurance Act* and *SABS* to reverse the priority levels for payment of medical and rehabilitation benefits (excluding medication expenses). Currently, under section 46.3(2) of the *SABS*, supplementary health insurance plans must be exhausted before auto insurance can be claimed. Under the amendment, auto insurance would take payment priority for portions of the expense reasonably available to the insured person, under the supplementary health insurance plan. ## What Does this Mean? This means that you are no longer required to submit any medical receipts/expenses to your collateral benefits available through your employer or partner’s employer. ## Why This Matters for Families For families, the changes mean more control over how they protect themselves on the road.
